Accident Investigation and Expert Witness
Kawns defines an accident as an unplanned or uncontrolled (adverse) event that has or could have resulted in injury, damage or loss to an individual or organisation.
Effective accident investigation is not only a moral and legal duty; it also represents sound commercial sense, as identifying and addressing the root causes of accidents guards against future incidents. A thorough investigation of an accident is also a positive visible demonstration of your commitment to safety.
Kawn’s Accident Investigation support service has been designed to help you ensure that a thorough and unbiased investigation takes place that explores all lines of enquiry and results in a prioritised remedial action plan designed to minimise the likelihood of similar accidents happening again.
A Kawns consultant will help you to swiftly identify and assess a wide range of evidence to determine both the immediate and underlying factors as well as the effectiveness of your accident response arrangements. A detailed report will be produced that describes the accident causes and includes a comprehensive and prioritised action plan.
Subsequent to your receipt of the investigation report and adoption of a remedial action plan, Kawn’s consultant can, if required, support its systematic implementation as well as verifying by audit that objectives have been met.
Control of Substances Hazardous to Health (COSHH)
Consultancy Services
These consultancy services are designed to assist organisations to:
Review and enhance their arrangements for the Control of Substances Hazardous to Health
Review current COSHH risk assessments and facilitate COSHH risk assessments for additional substances, or additional ways of using substances.
Review and enhance organisational arrangements for the Control of Substances Hazardous to Health
The Kawns consultant will carry out a comprehensive audit that will consider:
• The procedural arrangements for the management of COSHH against current best practice
• The degree to which these standards are achieved in practice.
A full and comprehensive report will be produced that will describe the current situation and include a draft action plan of how current arrangements can be enhanced.
Subsequent to receipt of the audit report and adoption of a remedial action plan, Kawn’s consultant can, if required, support its systematic implementation as well as verifying by audit that objectives have been met.
Review current COSHH risk assessments and facilitate COSHH risk assessments for additional substances, or additional ways of using substances.
The Kawns consultant will work with you to review the content and quality of current COSHH risk assessments in order to ensure that they provide a suitable and sufficient evaluation that covers the use of substances, the degree of potential exposure and the appropriateness of necessary risk control measures.
The consultant will also facilitate the carrying out of suitable and sufficient risk assessments that cover the use of additional substances or additional ways of using substances.
The consultant will then provide the client with records of the assessment in order to facilitate future reviews and to aid communication of hazards, level of risk and established control measures associated with the substance use.
Fire Risk Assessment
New fire laws place an increasing emphasis on your legal duty to carry out formal fire risk assessments. The Fire Brigade will soon have the power to revoke fire safety certificates, and in the event of a serious fire incident, prosecution proceedings could be brought against those found to have carried out an insufficient Fire Risk Assessment-particularly if Fire Rescue personnel are injured while attending an incident.
Kawn’s Fire Risk Assessment service has been designed with the advice of a senior fire professional specifically to help you comply with these new laws, whilst also prioritising areas for future attention.
A Kawns consultant will assess a broad range of risk factors including sources of ignition, means of escape, warning systems, and risk to personnel. Using a numeric rating scale and ' traffic light system' combined with qualitative review, the Kawns consultant will be able to make clear, even to busy management, the significance of any risks found. During consultation with the client, an initial action plan can also be developed to facilitate change if needed.
Kawn’s Fire Risk Assessment offers a highly flexible approach as users of the service can add further risk factors to the assessment where they may apply. Some buildings for example might have more difficult means of escape from fire than others, meaning that more specific risk factors must be reviewed in this area.
Inspections and Surveys
Our consultants are experienced in carrying out workplace inspections to assess conditions and compliance with legal and best practice requirements. The Workplace (Health, Safety and Welfare) Regulations place many requirements on employers to maintain a healthy and safe workplace, and Kawns consultants can assess, monitor and report on compliance with these regulations, and others, and produce a detailed report with recommendations for improvement where appropriate. The aim is to provide clients with common sense suggestions as to how they can better protect the health, safety and welfare of their employees.
One variant on the above service is the experience that Kawns consultants have in carrying out risk and liability surveys for insurance purposes. Such surveys can be carried out on behalf of insurance companies, or directly for client companies to assist them in obtaining and optimising their insurance cover.
Risk Assessment
The need to carry out suitable and sufficient risk assessments of activities and workplaces lies at the heart of most modern legislation. For example you need to risk assess the following areas
Management
Manual Handling
Workplace
Workplace equipment
Fire
Hazardous Substances
Noise
Dust
Vibration
Failure to do so not only compromises safety at a fundamental level, but opens the employer up to prosecution and civil action should an accident occur.
Kawns consultants can assist organisations in complying with their legal requirement, working with your employees to produce detailed and suitable risk assessments that can then be used to improve workplace conditions, working methods and training, amongst other issues. The Kawns consultant acts as an external expert; advising on the risk assessment process and suitable risk controls, utilising the knowledge and experience of those carrying out the work or otherwise using the workplace.
